Alexis Avila, 18, was arrested and charged with attempted murder and child abuse for allegedly throwing her newborn baby in the trash.
An 18-year-old mother from New Mexico, who was caught in a video of throwing her newborn baby in the trash, told police she did not know she was pregnant until the day before she gave birth to her baby in the bathroom.
Alexis Avila was arrested and charged with attempted murder and child abuse after her little son was found on Friday night in 30-degree weather, almost six hours after being thrown in the trash, clinging to life.
Avila is being held in prison and will soon be indicted in Lea County District Court.
The video showed a woman arriving by car before opening the back door and throwing a black trash bag into a trash can at Hobbs, New Mexico, on January 7 at around 2 p.m.
Six hours later, footage showed three people scanning the container before one of them found a child inside. It’s unbelievable that the newborn was alive.
According to a criminal complaint received by KRQE on Monday, Avila admitted that she had fired her child. The 18-year-old mother told police she did not know she was pregnant until she went to the doctor on Thursday due to stomach pain.
The next day, she gave birth to her son in the bathroom of her parents’ house.
After giving birth, Avila said she “panicked”. She wrapped her son in a towel, put him in a garbage bag, and drove around before throwing the baby in the trash at 14:00 at Broadmoor Mall.
In New Mexico, there is a Safe Haven Act that allows a person to leave an infant older than 90 days with hospital staff without fear of prosecution.
It was not until almost 8:00 that evening that a group of trash divers rescued the child after hearing him cry. The police were told that they originally thought it was a kitten.
Avila’s son was taken to Hobbs Hospital before being taken to another hospital in Lubbock, which has a more advanced NICU.
When the doctors evaluated the child, they found that his body temperature was so low that he did not register, which indicates hypothermia. The newborn has since received a blood transfusion and been given a tube and oxygen.
During her interview with the police, Avila was quoted as referring to her child as “it.”
Avila’s mother told the investigators that she did not know about her daughter’s pregnancy.

Avila is seen leaving in her car, which was later used to find her after she left her child.
Avila told police she did not know she was pregnant until she went to the doctor on January 6 due to stomach pains. The next time she gave birth to her son in her parents’ bathroom.
Jo Imbriale, owner of the Rig Outfitters and Home Store, where security camera footage was intercepted, said he was asked by police to check the video on Friday night.
He said to KOB, ‘Something was wrong, I saw the officers’ faces and they didn’t look right.
“I said, ‘What are we looking for?’, And she says, ‘We’re looking for someone who threw a black garbage bag in your trash can.’
Imbriale told KRQE that the video contained five hours of footage showing unsuspecting people “throwing rubbish at this child.”
The footage shows a woman – whom the police believe is Avila – enters the parking lot in a white sedan and puts a black garbage bag in it – containing her newborn – before leaving and leaving the child.
Other footage shows the moment the baby was rescued after people apparently heard the newborn’s crying.

The woman pulled out a garbage bag and reacted to what was inside. She immediately started taking care of the baby.
The child was packed before being handed over to police and rescue workers when they arrived shortly after.
Imbriale added: “I was only shocked to see it.
“I can’t sleep at night unless I know the baby was thrown in the trash just like that. I’m sorry, but who does it? This is evil. I have no words for that. ”
